What documents might assist me at my hearing?
You may use any information that you think is important for your case.  The types of documents you provide could include medical and psychiatric reports, drug lists, prescriptions and receipts, doctors' letters, separation and child custody agreements, immigration papers, and job search lists. The Tribunal member hearing your appeal will decide which documents to base the decision on.


Where do I send these documents?

Copies of the documents that you intend to use must be given to the Social Benefits Tribunal and to your local office or to the Disability Adjudication Unit.  You can send the documents by mail, fax or hand delivered.

Medical Evidence

If you are appealing a denial or cancellation of benefits under ODSP because the Director decided that you were not a person with a disability, any medical reports should be provided to the Disability Adjudication Unit and the Tribunal at least 30 days before the hearing.

Other Evidence

In the case of other evidence, copies of documents and written submissions that you intend to use at the hearing are to be provided to the other parties and the Tribunal at least 20 days before the hearing.

If your documents are not received by these deadlines you may not be able to use them at the hearing. It is not the responsibility of the Social Benefits Tribunal to send copies of the documents to your local office or to the Disability Adjudication Unit. The Tribunal Member will decide if you can use documents that arrive after these deadlines.



What if I forget to provide important information at the hearing?
Please try to make sure you provide all important information before the hearing.


What if I have more medical information to provide before the hearing?
Medical documents must be submitted to the Disability Adjudication Unit and the Social Benefits Tribunal no later than 30 days before the date of your hearing.
