Where do I get an appeal form?
Appeal forms are available at the Tribunal office, the office that made the original decision and community legal clinics.  You can print a copy of the appeal form by clicking here.  The Appeal Form is also available in electronic form for people with special needs. Contact the Tribunal office for more information.


Can I fax the appeal form to the Tribunal?

You can fax, mail or deliver your appeal form to the Tribunal office.



Where do I send the appeal form?
You can mail or hand deliver the form to Social Benefits Tribunal, 1075 Bay Street, 7th Floor, Toronto ON M5S 2B1.  You can fax the appeal form to 416-326-5135.
 


Can I get help to fill out the appeal form?
If you have any questions or need help with the appeal form, you can contact the Social Benefits Tribunal and ask for assistance. A legal clinic may also be able to assist you. You can visit the legal clinic web site at www.legalaid.on.ca


When should I appeal?
You may appeal to the Tribunal when you have been refused social assistance or when your social assistance has been cancelled, reduced or put on hold, and when:
 
  1. you have requested and received an internal review decision, or
  2. you have requested but not received an internal review decision within 10 days of your request.
 
From the date of either 1. or 2. above, you have 30 days to file an appeal. You must use the Social Benefits Tribunal Appeal Form.
 


What if I don't receive an internal review decision?
You may appeal to the Tribunal after 10 days have passed since making the request for internal review. You then have 30 days within which to make an appeal to the Tribunal.


What if I don't get my appeal form to the Tribunal in the 30 days?
If you are late filing your appeal, you must state on the appeal form the reasons that you are filing late.  At your hearing, the Tribunal member will decide whether to consider your appeal.
